General Terms and Conditions of the humax.si Platform

1. Introductory Provisions and Provider Identification

1.1These general terms and conditions (hereinafter: the Terms) govern the operation of the Humax.si online platform and the rights and obligations between the service provider and users.

1.2The service provider and platform operator is Denis Čurčić, s.p., Petronijeva ulica 4, 6000 Koper, registration no.: 8104778000, tax no.: 70680825 (hereinafter: the Provider or HUMAX).

1.3HUMAX operates under the HUMAX Ecosystem brand as an organisational-technological intermediary (executive concierge).

2. Legal Nature of the Platform and Limitation of Services

2.1HUMAX is exclusively an informational and organisational intermediary platform. HUMAX is not a healthcare provider, does not perform medical services, does not establish medical diagnoses, does not carry out treatment, and does not maintain medical records under the Healthcare Activities Act (ZZDej).

2.2All physiological measurements, analyses, kinesiology assessments and expert consultations are carried out by independent, licensed professionals (members of the expert panel) in their own name, on their own account, and under their own professional and liability responsibility.

2.3The intermediary service comprises appointment coordination, IT infrastructure, organisational support, and the technical pseudonymisation of biometric data.

3. Ordering Services, Pricing and Payment Terms

3.1The user submits an inquiry via the online form or directly through the Executive Concierge's communication channels.

3.2The prices of organisational services and of services provided by external providers are set out in an individual offer or pro forma invoice. All prices are stated in euros (EUR). The Provider is not liable for VAT on the basis of Article 94(1) of the VAT Act (ZDDV-1).

3.3Payment is made on the basis of an issued pro forma invoice, by bank transfer or via supported payment systems, before the service begins.

4. Right of Withdrawal (ZVPot-1)

4.1In accordance with Article 130 of ZVPot-1 (Slovenian Consumer Protection Act), the consumer has the right to notify the Provider within 14 days of concluding a distance contract that they are withdrawing from the contract, without stating a reason for their decision. The withdrawal notice must be sent to info@humax.si.

4.2Express consent to early performance of the service: If the user requests that organisational services or the initial consultation be carried out before the 14-day withdrawal period expires, the user must submit an express request and consent.

4.3Loss of the right of withdrawal: In accordance with Article 135 of ZVPot-1, the consumer loses the right to withdraw from the contract once the intermediary service or initial consultation has been fully performed, provided that performance began at the consumer's prior express request and consent.

4.4If the consumer withdraws from the contract after requesting that performance begin, but before the service has been fully performed, the consumer shall pay the Provider an amount proportionate to the services performed up to the moment the withdrawal was notified.

5. Exclusion of Liability

5.1The Provider is not liable for any material or non-material damage, personal injury or health complications resulting from the actions, advice or measurements of external licensed professionals. The user shall pursue any claims for damages directly against the professional service provider.

5.2The information and content on the humax.si website is provided for informational purposes and does not replace professional medical consultation with your personal physician.

6. Dispute Resolution and Competent Court

6.1The parties will endeavour to resolve any disputes amicably.

6.2If an amicable resolution is not possible, the court with subject-matter jurisdiction in Koper shall have jurisdiction over any dispute.

In accordance with Article 32 of ZIsRPS (Slovenian Out-of-Court Settlement of Consumer Disputes Act), HUMAX (Denis Čurčić, s.p.) notifies that it does not recognise any out-of-court consumer dispute resolution provider as competent to resolve consumer disputes.
